What is the name of your state?California
She is disabled and feels sorry for him, he is rude, selfish, jumps down caregivers throat if they accidently use his stuff, he's 43 yrs old and just received his share of the home him and his ex sold, claims he's invested it to use to gain custody of his 3 girls. Ex is not a bad parent, so I don't beleve he has a leg to stand on there. We will be going to see attorney in 2 weeks should we ask for guardianship of our mother? She receives combo of Social Security and SSI disability $711.00 a month

  • Your brother moved into your disabled and elderly mother's house after his divorce, which resulted in the sale of his house.
  • You want to a) Buy your mother's house or b) Have her declared incompetent, and manage her affairs, so that you can then evict your brother.

My sister and I are her power of attorneys, we will be going to see the attorney next week to remove a brother from the will (at mom's request) If she wants to remove someone and we then want to start guardianship/coservator, how will that work? If we want guardianship it's because she's imcompetant, if she's incompetant how can she know she wants to remove my brother from will? See what I mean. Also, what if my sister and I just get our name put on title with mom, do we have the power to evict him?
