I belong to the Teamsters Union and the officers of the local have been removed for corruption, my question is when they get handed down suspensions with in the union will they lose their seniority with an employer?
Are there any federal or state laws stating that they don't have to be in the union to maintain their seniority?
I heard that there is a law that if a union won't grant you membership or you are thrown out of a union the employer can still hire you, not sure if it's true though and don't know if it would apply in securing ones seniority.
In my contract it states in (Article 2 Union Security and Checkoff)
Section 1. Union Security
All present employees who are members of the Union on the effective date of this subsection or on the date of execution of this agreement, whichever is later, shall remain members of the Union in good standing as a condition of employment.
When a member is suspended from the Union for a period of time he/she is not a member in good standing. I believe the above supports taking away their seniority with the employer. I'm looking for laws that would contradict the above or where to look for those laws.
