My estranged husband had 2 illegal alien girls pregnant.
We never got divorced, just were separated for 6 years and now we are trying to make it all work,however... Like I said - he's been running with 2 college exchange students from our Home-country overseas and got'em both pregnant. Now they are both overstaying their student visas in order to hide the pregnancies from their families over there.Yeah,in traditional and rural communities over there it is a great honour to study in the US & a terrible disgrace to have a baby out of wedlock!
One is due any day & the other - late October.
My husband's idea is to sign the birth papers for the newborn and have the birth mother to sign her parental rights over to me. I DO NOT mind, not cause only I still have feelings for the man,but cause I also wanna help him raise those kids: I do not work and have some estate to manage, therefore I am set.
If we do it without a lawyer, just a notary - will it be ok and legal ?

Frankly I STRONGLY advise against your proposed plan and you really do need to speak with a local attorney to guide you further.

The basics are:

A notarized document means nothing; it only confirms the identity of the people who have signed the document and Mom cannot "sign over" rights to you; she can of course let Dad have sole legal and physical custody but it really does need to go through the court system. If she doesn't want this, then it's not going to happen.

Perhaps later on you can see an attorney about completing a stepparent adoption. Assuming you're going to remain married, anyway.

I can't emphasize enough though, that your plan is fraught with potential trouble and not necessarily in the best interest of the child/ren.

Sigh... Before you even consider taking on your "husband's" spawn, you should seriously consider counseling for yourself. AND speaking with an attorney.

Thanks for your reply, Proserpina !
Why is the plan fraud ? Children will need a mother. The girls will escape to their home country the moment they will be able to walk.
Break it down for stupid:) please.

1. I said "fraught". Dictionary.com is your friend.

2. The children need stability; the gender of the parent is irrelevant and your husband is not exactly a paragon of stability.

3. Your marriage is already in trouble; do you really think that taking on the children born of his infidelity will make things better?

This is a train-wreck waiting to happen.

Why everybody in this country thinks that shrinks and lawyers are some kind of gods ?

1. Русский язык - это мой первый и основной язык, пардон великодушно. Это Ваш почтенный друг : https://translate.google.com/

2. My husband works and he is very stable financially. Taking care of a newborn will keep him from his job.

3. I do not care about that - we are still married and fidelity or not we are still ok.

All I wanted to know how to make it legal. I want to be a mother and he is the father.

Then you will need an attorney to make it legal. A notarized letter is NOT legal.

Yes, we know you don't care.

That much is screamingly obvious.

You're welcome.

Ok... Let's see what the FL Statute says about that ?
Front door or back door adoption - what is the difference ?

A back door adoption is an illegal adoption. If you want to legally be the mother of these children then you need to hire an attorney to help you do a legal adoption. You cannot do it with a notarized piece of paper.

Allright. Thanks! But notarized paper is the beginning of the process, isn't it ?
