Lost Tax Intercept Money

I'm hoping you guys will have some advice/suggestions/ideas.

My husband pays support through SES.

We filed our taxes in Jan or early Feb. Got back federal refund, waiting for state refund.

We get a letter Feb 23 that LDR (Louisiana Dept of Revenue) had intercepted our state refund (about $400) due to a Notice of Levy from SES reporting that he was in arrears.

He is not in arrears, he was not at that time, he has not been at any time since the fall of 2005. SES says you have until the last day of the month to get & process the payment, they received Jan's support on 1/29 and Feb's payment on 2/27. He has NEVER been in arrears except for 3 months worth, which werent true "arrears", they were arrears for the 3 months from date of filing in 2004 (CP filed to establish support in Sep 2004, order was est in Dec 2004). Those arrears were paid off before the end of 2005 because he had to have arrears paid off to claim the child on taxes (he is allowed to claim every year as long as he is not in arrears). So again, there were NO ARREARS anytime recently, and no reason for them to intercept.

Anyway, after many calls to SES, they told him it would be easier to let the $ go through to them, because it could take up to 6 months to get it back to him if he filed to contest the remittance. We got 3 different answers on how long it would take for SES to receive and process it, and that he could then just send in the less than $100 difference the month they processed it, as he would have a nearly $400 credit once they processed it. The 3 different answers were: 60 days, 6-8 weeks, and 12 weeks.

12 weeks from when LDR intercepted the return was 5/18. Yesterday was 5/21. I went online to check if they had gotten it, and it was not showing up.

So I call SES and they said they never got it and they tell me to call LDR.

I call LDR, who says it WAS sent. She said it was intercepted and sent somewhere between Feb 12 and March 12.

So....now what?

I sent an email to the email for the "case contact" on file about what is going on, and that I would appreciate her prompt help in clearing this up, because I did not want to take up more of her time than need be, but I would be constantly in contact with SES and LDR until this matter was settled. The extremely unhelpful response I got was this:

report of income but legally, everyone is required to report their
income every year. There is no guarantee that payment will be
intercepted but if all requirements are met, the action is submitted
consistently ongoing until the arrears are paid. If we receive the
funds, they will be applied to the case and may be held for up to six
months while processing. For any case specific information, you may
contact the Customer Service Center at 800-256-4650 or locally from
Baton Rouge at 225-922-8100. Thank you for your inquiry.

Anyone dealt with this? Have any suggestions or ideas on how to get this taken care of, something I'm not thinking about??

The fact that they have apparently "lost" this money (SES, I dont believe this is LDR's fault, esp since SES is such a clusterf*** and we've had so many problems with them before....we all know SES is a terrible agency, most often worthless) is just insult to injury. They never should have intercepted it in the first place, and now its been 12 weeks and they have no idea where the $$ is.

SES is the bain of my existance.
