What is the name of your state? Arizona My ex lost his job due to health and is already in arrears. Our daughter is 23 and son turnes 17 next month. He offered to cash in his fiancee's insurance policy and give that amount to me but maintained its all he can get. Its about half but its more than the payments he missed come to. The bulk is in arrears that he didn't know about. I said I'd accept it but he said he wouldn't let her surrender it unless it cleared this debt. He didn't want to remarry and have her inherit the the obligation. We've had a pleading signed and notarized agreeing to the lump sum amount and that all payments, arrears, interest and future obligations be cleared permanently. He's sending me a cashier's check made out to the clearing house and I'll present both. My question is this... What happens if I put the check through but don't file the petition? Legally, I think he'll still owe me the remainder and still have to make monthly payments until he's caught up. Can he get the lump sum back from me?

His Fiancé's money is not his to pay anything with .
A notarized Statement means diddly squat.
Is he being threatened with Jail time and/or collection actions ?
One child is an adult and the other is old enough to work part time.

What is his disability ?
Will he receive SSDI and/or SSI ?
If he will receive SSDI you will receive some money for the 17 yr. old living at
home.
