Minnesota is the state that is in question: My employer takes a half hour out for lunch. Regardless if we are able to get away from our department of not. Any worked hours over six and that half hour is deducted. There are many times that you work at 12 hour shift with no break, and thats fine but then is it leagal for them to deduct that half hour? After considerable lenght of employment this could add up, we have two people every day that they work that don't get a break but still get the lunch break deducted

If the employee works through their lunch break, they have to be paid for it.

However, the employer may legally discipline the employee in any other way they choose for not taking a lunch break if the employer wants them to.
