Making up time

What is the name of your state?California

I am new to this company and therefore am not eligible for sick or vacation time. Last week I took Thursday afternoon and Friday off. However, on Wednesday before I took the time off I told my boss that I would need to make up this time on the weekend. At that time he didn't really say anything but I know he heard me because we only sit five feet from each other. Today when I turned in my timecard showing hours on Saturday and Sunday, I was told that I am not allowed to make up time and was told deduct that time from my timecard. My company has provided me with a laptop which comes with my job. I did come into the office on Saturday to run the reports that I would need to compile some spreadsheets but then I did the actual spreadsheets at home.

I have never been told before that I could not make up time or work at home. I have only been told there is no overtime which is fine with me. Let me add that I am non exempt.

I'm pretty sure they have to pay me for these hours but I would like confirmation. Beth, are you out there?????

Yes, since you have already worked those hours they have to pay you. However, for the future, know that they do NOT have to allow you to make up time just because you want to, and you can be disciplined (via any method they want other than refusing to pay you, up to AND INCLUDING termination) for working unauthorized time. So before you make up any time again, get approval IN WRITING.

CBG, thanks so much for the info! I haven't been on here for a while so I kinda forgot about you (sorry). I'm a big fan of yours and Beth3.

Believe me, this isn't my first rodeo. If I thought for one second that I wasn't allowed to make up time, I sure wouldn't have spent 11 hours of my weekend busting my butt on something I wasn't going to get paid for.

's okay. Beth and I are sometimes considered to be somewhat interchangeable anyway, which is kind of strange when you consider that she's about three feet taller than I am, and that she's a blonde and I'm halfway between a brunette and a redhead. But we usually (not always, but usually) have much the same advice.

Can't disappoint a fan! :)

Don't want to start a new thread and I know this isn't your area of expertise but I thought I'd go ahead and toss this one your way. Not to mention, I know you won't shake your finger at me. :)

About 8 years ago (when I was less mature, MUCH LESS), I was overpaid by EDD for unemployment to the tune of about $1,600. Well like other debt dodgers, I thought this issue would eventually "go away" so I just ignored it. Well now that debt is up to $3,800 including interest. I can see a garnishment comng in my rear view mirror any day now. Now that I'm in a little bit better financial situation, I would like to make arrangements to pay off the principal over the next 6 to 8 months. However, EDD says they don't take settlements. Do you know if this is truly the case? I would like to talk to an attorney about this but not sure what kind of attorney I would talk to. Maybe an attorney could help me get a settlement of $1,600.

Your thoughts please..............

Honestly don't know the answer, sorry. The employment-related laws in your state are often different than in the other 49, and it's not something I've had occasion to research.

I know someone who might know, and I can run it past him and see what he says. That's the best I can do.

Well, Well, Well. What a surprise......I showed up for work today only for my boss to tell me that he will be paying me for the "make up time". I guess someone must have "enlightened" him the night before. Of course I had to sign the standard "do not work overtime or make up time without prior approval" form. Which was fine with me (Although I'm not used to having someone scrutinize my time.) In addition, my boss was unusually nice to me today. Hate to be pessimistic but I think I better watch my back. I've only been with this company since June but I've seen them raise a number of eyebrows.

Glad it worked out for you. It's always better to have them pay you voluntarily than have to go to the DOL. Hope he remains enlightened.

On your other issue, they don't have to take partial payments if they don't want to. I think you're going to have speak with a local attorney. One who has employment law experience would be best. Hopefully an attorney can help you convince them. Don't count on having the interest and fines removed; however you with an attorney's help maybe you can pay the initial overpayment in one installment and the interest and fines later.

Well for a minute there, I thought I might be able to relate since I'm 6' tall. I was under the impression that cbg was telling me you were too. :)

SAK2000, Beth is about 5'9" or 5'10". I'm 5'2".

Being this tall, I have a lot of sympathy for my girlfriends who are around 5' to 5'4 I hear the same comments except on the other side of the spectrum. Instead of OMG, you are so short. I get the OMG, you are soooo tall. Why do people do that?? Is it supposed to be a compliment?? It drives me nuts. Noone would ever go up to a fat person and say OMG, you are so fat!! :D

I met a really tall guy one time and he taught me to say the next time someone says "OMG, you are so tall, did you play basketball?" I just say "no, did you play minature golf?" :D :D

When I say, "I'll be there/do that/call them back/whatever shortly", Mr. CBG answers, "You do everything shortly".
