What is the name of your state (only U.S. law)? pa- there is this guy who is a member of our HOA, he was president of our board of directors but has resigned the position. he continues to have his hands in all the financial business for our HOA. ifs this legal being that he is not an elected official, elected by the HOA?

Depends... every homeowner should have the right, per the by-laws, to 'review' the books.
What did the current Board of Directors say when you voiced your concerns to them.
