What is the name of your state?MN
I heard(not sure whether to believe the source)that when you are going through a custody evaluation and one of the parties tests positive for marijhuana use that is really no big deal.. But if the drug teat was positive for things like meth,coke, estacy,etc..that would be a bigger deal. Isn't drug use
all the same?? Doesn't it look bad no matter what you are doing?

I think you should approach the drug test as if anything positive could have a major impact on how the judge would rule.

I think legally a drug is a drug is a drug. However, at least in my state of CA, I've seen testing positive for THC have little impact on custody. On the other hand I've seen rehab history or DUIs re; Marijuana be very relevant. I am assuming it's whether you can demonstrate the parent is a chronic or drug abuser, as opposed to someone who's maybe used drugs once or twice??
 
I can speak from first hand experience in this matter. I requested a drug test in court on my daughter's father. He took it and failed. He tested positive for marijuana and cocaine. The judge said that if it were just the marijuana he wouldn't be as concerned. But the cocaine (it was shown where he used while he had my daughter for visitation) was enough for the judge to immediately suspend all visitation and face to face contact. Some judges may feel differently.

yah..Isiah was the drunk on little house on the prairie,
but it has nothing to do husband's case...my husband has fought a long hard battle with his ex-wife to protect his son. His son is in a very bad situation. I don't appreciate the rude comments..may I question you?..are you the addict? With comments like that, I wonder. I come on this board for advice, not bashing!!!

I don't think you were being bashed. I think that was an attempt to interject a little levity onto the board. We honestly need that sometimes. The issues we all deal with are so serious that a little levity is needed.

No, he is not bashing you. There is a lawyer from California on this board that had a link showing some trailer houses and the toilets, refrigerators, etc...that would be in their yard. It would give us a laugh. Sometimes going off topic (like the Little House on the Prairie bit) just helps lighten the mood on the board sometimes.

I'm from MN too, and you and I both know we don't have trailers in MN. :D
