after 7 years of child life and 6 years after me and my ex wifes seperation i found out through dna testing that the last child born to her while we were married is not mine i have been paying child support for this child am i still responsible. this is a clear case of paternity fraud can i sue the state or her for this loss of money i have been requesting a dna test for 6 years social service told me i was 7 days late in the time allowed to contest paternity after this i had financial hard times and could not persue this through a private lawyer at that time i also went to jail for two weeks because i could not pay child support the marriage took a toll on a 55,000 a year job and my life i am back on my feet i am willing to persue this till i die my case is in the north caroina courts now and at the general assembly in raleigh trying to get a bill started to rebut this marriage as a presumption of paternity.the bill i am trying to introduce paternity proven through dna testing in maryland its called the milkman law we need this in north carolina

a child born during a marraige is assumed to be that of the husbands. if you were placed on the birth certificate you have a time limit on contesting the paternity of the child.

in most states that time limit is 4 years. since the child is now 7 years of age - that time limit is expired.

in the eyes of the court - although it may not be fair - you are the father and are legal bound to support the child.

well i contested the law marriage as presumption of paternity and won i did a lot of research and many states are putting amenments in place so this law can be rebutted in maryland its called the milk man legislation it states that if a man can prove paternity fraud through dna testing he can challenge MAP and have unjust chil support payments stopped
