I'm Canadian and I'm in the States legally for the moment. I'm waiting for my divorce to be finalized about another 2 months max. Then I'm planning to wed my fiancee who is a US citizen. How should we go about proceeding? I'll be illegal by the time my divorce goes thru . Should we do the K-1 or the I-130? Or is there something else simplier making it possible for me to work in a shorter time frame?

The proper way is to have the USC apply for the K1 visa and then for you to return to Canada before your visa runs out and for the interview.

You could also marry the USC whilst still in the US (when your divorce is final) but there is a *slight* risk with that is they decide that was your intent when you entered.
