Hi, my name is Faruk and I'm from Uzbekistan and my bride too, and we have a wedding soon and she is the holder of the green card, she is now studying in the US. I read on the Internet that the processing time takes 2 years or more my question is, can I get the visa in Canada? Can i wait processing time in Canada? I want to know whether this harms the process? Am I breaking the law? Thanks a lot in advance

That question really needs to be answered by a US immigration attorney who is familiar with both your and your to be wife's cases. I can certainly understand why you would prefer to wait the time in Canada, but an internet forum is not the place to get answers to a question that I that complex.

You need to speak to an immigration attorney. Some of your wording has me concerned not only about YOUR status but about hers.

As far as whether you can wait in Canada, I don't think anything in US law cares. I've had people I've been trying to get into the US do that. The issue is they were all Commonwealth citizens (one Indian, and the other British) which have an easier time with Canadian entry. I can't tell you if you're going to be able to spend an extended time in Canada. One thing you need to be careful of in the US, is to be careful coming to the US with non-immigrant visas when you have clear immigrant intent.

Some other questions is how long has your fiancee been an LPR? Another issue, is as a student, is she going to be able to qualify for the affidavit of support.

She came to the US about 11 years ago with her parents, winning a green card, is it enough to be LPR? You want to say If she is a student, she can not claim affidavit support?

In order to sponsor a person, one has to show that one has the income and/or resources to reasonably guarantee that the person being sponsored will not receive government aid.

If you wife is a student, her income might not be high enough. And she probably doesn't have a lot of financial assets. This has nothing to do with her LPR status. She would face the same requirement if she were a citizen trying to sponsor you.
