The first marriage took place in Mississippi and the second in North Carolina.

I have a friend who niece has been married for about six years. She and her husband has a small child. The problem that they are now faced with is that they recently found out that the husband who was suppose to have been divorce from his first wife is still legally married to her. The husband recently attempted to obtain a divorce decree from the county that the divorce was suppose to have been dissolved. The county clerk inform him that the divorce was withdrawn even though paper work was sign by him and the first wife and was sent to the lawyer hired by his wife to end the marriage. The husband of my niece from what I understand was never inform of the paper work being withdrawn and was not required to come to the court since he did not reside in that state. He assume that everything was taken cared of since he was sent copies of the termination paper from the lawyer stating the reason for he divorce that required his signature. I understand that the first wife is suppose to be re married as well with a child of her own. Can anyone give me advice for the couple who truly love each other and do not want to break up their family.
