What is the name of your state (only U.S. law)? NY

My wife is going on maternity leave in a few months. She has a low hourly rate and makes her salary via weekly bonuses based on each client she has sign a contract with her company. Now when she goes on maternity leave, her disability is based on her hourly rate which is about minimum wage and her company will actually see a huge profit since they will be keeping that weekly bonus check. Is there anything that can be done about this? She did all the work to bring in these clients.

How do you figure? You're wife isn't bringing IN the money that her bonus is based on, so no, there is no "huge profit" by them not paying out a weekly bonus check.

That's going to depend entirely on the bonus program.

She gets 10% of the contract for each client and it is paid as a weekly bonus for the length of the contract.

The clients sign contracts for 10-20 weeks. So by having her on maternity leave, the company keeps that 10%.

Got it. See cbg's reply above.
