I am a 2nd grade teacher in California. I took my maternity leave in April '04, and was verbally told by my principal that I would be paid for 30 day of maternity leave, plus I could use my 16 days of sick leave. I went ahead and used all of that time off. We are now in July '04, school has ended, and my school closed down permanently. Since I was contracted to be paid on a 12 month pay plan, they are still paying me. My contract states that I will be paid through Sept. 5, 2004. My contract also does not mention anything about maternity leave.

My problem is that I just received a phone call from the principal a few days ago. He called to tell me that I will be docked my last month's wages because they cannot afford to pay me for the maternity leave. Can they dock me in August for the maternity leave I took in April & May?
