I am asking on behalf of my husband which has a son who is the mother having a full custody. In the divorce paper said, he can visit anytime that allow by the mother (custody parent), which means he doesn't have the say at all.

My husband is in the army and stationed oversea for many years, but now is in US and he really want to spend more time with his son. He is a good father, never fail to pay child support, call his son regularly. Since we moved to Maryland about 3 years ago, we had him most every other weekend and also summer, but it depends on his mother mood, if she said okay, then okay, if not she can do whatever she wants. Now we moved to anoter state, we fly him once on summer and hoping that he can spend the whole summer, but his mother said its only for two weeks. It looks like she is using the son to make my husband upset.

My husband would like to change the court paper about visitation, which give him rights to have him on certain holidays and summer break without she interrupt.

How long this process will take? Is it expensive?

The amount of time a modification takes varies from case to case, depending on things like how crowded the court docket is, and how many motions and hearings are needed for the case. For a possible time frame he can check with the court clerk who can give an "average" estimate.

Also check with the court clerk to find out what the filing fees are. He can file the papers himself, or hire an attorney. If he wants to do it himself, the court clerk will be a good source for finding out where to find the proper forms. Good luck.
