MD minor traffic violation and employment background check question

I had a minor traffic violation in 2012(Driver failing to yield to emergency vehicle with signals). I paid a fine of 110$ an got 1 point on my MD driving record. MD MVA automatically expunged this after 3 years from the records as the driving record was clean. When a record is expunged I read that the offence legally does not exist. I checked my MD driving record and it shows no violation and shows 0 points. I am applying for a private job and in their background investigation there is a question "have you ever had a traffic offence in the last 7 years? If yes please explain". Should I answer yer or no to this question? Thanks in advance.

It's not "expunged." The points just stop counting against you after three years. If they request the "three year" driving record, they won't see it. However, if they get the full driving record, older convictions and even PBJs will appear. Since they ask about SEVEN years, chances are they are looking at a commercial version of a full driving history I would guess.

You should NEVER lie on an application. Liars are a bigger issue than bad drivers.

I took the full driving record from MD MVA and it shows no violations and 0 points.MD MVA states the following: Many motor vehicle records are automatically expunged after 3 years; other records may
be manually expunged, depending upon the offense for which you were convicted and the
length of time since your last conviction. For additional information, contact the MVA.

That is the reason I was wondering if I should mention about an expunged record on my application. Please advise.

Lie at your own peril. Even if it was expunged doesn't mean you weren't convicted of it.

Thank you for your advise. I read that expunged records mean that legally they don't exist and you are moved to a point before the conviction. So I was just looking for the right way to answer this question. If answering yes is the right way to do it, I would do that for sure.

Your screen-name suggests that this is related to an immigration application - yes? If that's the case, it's even more important that you tell the truth on your application.

Actually it is a job application with a private firm and not immigration related. I am saying yes and giving the details of the traffic ticket in 2012.
