I was responsible for my son's medical insurance and expenses after the 1st $100 each year. Because my ex refused to go by the ins. rules, I've been stuck w/2 bills for $220. She incurred two bills in the end of August. I was notified of one bill for $105 in the middle of Sept. I contacted the hospital & gave them the ins. info. I've not received anything from the hospital since then. Tonight, I was told of a 2nd bill for $115 that was from the same E.R. visit in August.
If she'd gone by the ins. rules, I'd have had to pay only a $50 copay. She's been told numerous times in letters, e-mails, and recorded conversations what the rules were. This is not the first time she's done this to me. However, on the other occasions I was able contact the ins. company & hospitals on time w/the correct information.
Can I do anything about this since I should be responsible for paying only a $50 copay? If I pay the bill, can I take her to small claims court to make her pay me back for the $170 difference?
