I went to the Hospital emergencey room on a Sunday morning suffering with chest pain and having a hard time breathing. I thought I was having a heart attack but was not sure because I had never had heart problems in the past. I was taken back and hooked up to some monitors and they began to take some test. After taking EKG and some chest x-rays the doctor informed me that is was not my heart and they were going to check the chest x-ray. After looking at the chest x-ray I was told I did not have pneumonia. I was told it was pulled muscles in the chest wall more than likely and to make an appointment with my doctor in the morning. The next morning the hospitlal called me back to inform me I needed to get in soon as possible because the radioligist looked at the x-ray and I had a collapsed lung. I knew all along something was wrong when I was no better after taking pain medicine they prescribed. I ended up having lung surgery for what they call a spontaneous pneumothorax. This should have been detected in the emergency room that Sunday if they looked at my x-ray like they said. When the doctor showed me the x-ray you could see it so plain because the heart and the esopgagus was pushed over to the right . I suffered alot of pain for 24 hours hurting and not being able to breathe. I could not even lay down to sleep that night I had to sit upright all night. I felt like I was having a heart attack because of the pressure that was on the heart from the lung being deflated. I am not sure if surgery could have been avoided had they inserted a chest tube on the day I went in to the emergency room. I have read that sometimes this will repair itself with a chest tube insertion. Could more damage have been done being that they waited 24 hours. Do I have any legal action I can take against them.

Sounds like they made a big mistake.

Any money you had to spend to go back to the doctor plus that bogus visit and any pain and suffering is what you are commonly entitled to. Sometimes statutory law will also dictate amounts of damages. You need to hire a medical malpractice or personal injury attorney to file a claim against the hospital/medical center and specific doctors involved in the misdiagnosis.

Thank you for your response. I appreciate the information you gave me. I am going to contact a medical malpractice lawyer and proceed with this. Something needs to be done with this hospitals emergency room. I have found 2 other cases that were misdiagnosed just on the same street that I live on. I can only imagine how many others might be out there. Thanks again.
