What is the name of your state? Michigan
my husbands is court ordered to carry Ins on his minor children which he does. he is court ordered to pay 100% of anything not covered by ins, and he is court ordered to pay 50% of any copays. his exwife, also has medicaid on the children thru adoption. what type of proof can my husband require his ex to provide as to expenses she says she paid? she purchases top of the line glasses for the kids that the insurance doesn't pay for in attempts to break us financially. what can my husband do to protect himself?

It sounds like he's going to have to get the order changed to reflect a 50/50 medical out of pocket cost distribution.

I always assumed that in cases where kids have both private ins. and medicaid, the private ins. was used first then any balance was submitted to medicaid. best case scenario in that case is no one pays any out of pocket cost.

veronica gia is right. You should petition for 50/50 uninsured medical, but I would also add that the parent who goes out of network, choosing doctors or treatments (such as glasses) not covered by either plan, pays 100% of the cost if the same or similar services were available within the ins plans.
