What is the name of your state (only U.S. law)? FL
I understand that MERS is the electronic repository for mortgages and that many mortgages have MERS as the mortgagee. Unfortunately, an individual can't seem to gain access to get information which is there and the "Contact us" part of the site doesn't work correctly so a message can't get through.
The question derives from a property which was sold and a "discharge of mortgage" was supposed to be sent. Never sent. The original mortgage is still recorded on the county site. Obviously, a satisfaction/discharge document must be recorded to offset/clear the original mortgage. It isn't. Nor is the "release of lien".
Interestingly, this property has transferred for the second time since the mortgage in question was issued. The old mortgage is still recorded, no dicharge or satisfaction is, and the title transfers.
So, the question really was whether the satisfaction is recorded elsewhere. Otherwise, there is a serious cloud on the title, in my view.
