I would like to get some feedback regarding an idea.

Husband and wife are going through a divorce - amicable. They both agree that wife can stay in marital home. Neither have a great deal of finances.

A) Both refinance marital home, and takes a portion out to purchase a second home and 1) they keep both properties jointly or 2) each quit claim respective properties. In two years, marital home is refinanced or sold to provide husband with rest of shared equity.

B) Wife refinances alone, gives husband agreed upon share based on equal equity, husband purchases another home, each quit claim other off of property. Wife refinances in two years/or sells and gives husband rest of his portion.

Purpose is for keeping children in marital home and having a comfortable place with other parent. Appreciate the thoughts and suggestions....

Chose the option that gets one spouse completely off of the title.

I have seen too many of these amicable divorces turn into the roaring fires of hell.

In other words, craft a plan that both of y'all can live with, but craft it with the idea that the day after it is signed, y'all become bitter enemies. If the plan would still work under those circumstances, then it is a good plan.
