I am working with migrent workers in Tn. and I am trying to help a family that 2 children were taken from the mother which was negleting them and the father has now been able to get his children back with him. He is not living with the mother and they were never married. He has been told that because he is illigal he has not rights. His brother and sister in law want to adopt them with his permission and dcfs has not wanted to turn the children over to anyone one of them. I was told that dcfs was to place the children with family before putting in foster home! The brother and sister in law have had all the inspections from dcfs and passed with flying colors. The foster mother want to adopte these children, she signed a paper from the agency she would never put in for adoption, please adivise! The state is tying to terminate fathers fights because of status and mothers already terminaged.

The state can not force termination of the fathers rights if the only charge is he is in the US illegally. For the other family members, they would be best to petition the courts for custody rather than allow the dcfs to decide. That is, if the father does not mind losing custody. Have them get an attorney asap and file a petition into court.
