Hi there
my husband is currently serving with the united states army reserves, he is back from the desert.. last year the biomom took the son from the primary home, she never let the new wife see him or have any contact with him. according to the custody arragnements the son lives with the father for ten months out of the year, and now she wants to change it all, she has petition the court to change the custody..in fact there b is a hearing on march 31 of this year.. she wants the son until the father military career is over.. i have asked my husband why doesnt he have her arrested since she is violation of the prior custody agreement,,this whole situation is horrible... i know the court will seek what is in the best interest of the child,,how can a person ask to give up their career.. i have read many briefs in their divorce and the bio mom said that he will always put his military career in before the family,,, i as being the new wife knows this is not true, he is a good family man,, you cant tell uncle sam no, oh you can but you will also go to jail,,,my question after all this, will the court grant the biomom custody and make the father choose, the father has over 20 years in,, i for one would never make a person choose between what he loves to do the bio mom does not leave far,,,i can only see the can of worms opening on this one, i know im being over dramatic here,but is she wins this one, i can only quess what could be nice,divorce the new wife and you get your son back,

She's certainly permitted to file for custody. If Dad is/is likely to be deployed, the question would be why does it make more sense for stepMom to raise the child than for Mom to do so?
