Hello All,

I have an important situation that I was hoping someone could shed some light on. I am a veteran and served in the Navy for nearly nine years; recently got out in 2013. In 2008 my wife lost her job and our family came into some financial hardship. Because of her loss of income we were unable to make our full mortgage payments each month. I called the bank and informed them of the situation but informed them of my intentions to pay what I could. Shortly after that while on deployment in 2008 without notice they foreclosed on our home. For some time someone from the bank kept coming to our house and threatening my wife saying that she needed to leave the premises as soon as possible. Eventually, My wife and kid were evicted and I was unable to get home to help in anyway. I heard that it is illegal to do that to a member of the Armed Forces while out of country but I don't know if it 100% true. Due to the foreclosure and marital stresses it caused, and lack of money, we could not pursue legal help. Is there anything that can be done at this point in time? Is there compensation or way to get my house back? What are my legal rights and how would I go about resolving this? Thank you in advance for any help or guidance you may provide.

The Soldiers and Sailors relief act. Currently under a knew name, protects servicemen from these things when deployed overseas. That said you needed to get an attorney involved to invoke your rights and you failed to do that.

As a Service Member you (or your wife) could have contacted JAG for free information and advice. But that ship has sailed.
