My OB/GYN diagnosed me as Rh negative my 10th week of pregnancy and treated me for this throughout my pregnancy. At 7 months, she gave me a vaccination treating me for this. She also informed the hospital of my delivery so that when I arrived, they would also treat me for this. On the day of my delivery, the hospital found that I was not Rh negative. I later found out that this same doctor, who had done a surgery of mine two years earlier, wrote in her postop notes that I was Rh positive. If she had looked back in my records, she could have avoided the misdiagnosis and treatment. Luckily, there has been no known side effects to me or my daughter because of the vaccine. However, undue stress for 7 1/2 months for my husband and me was uncalled for. Do you think I have a reasonable suit?

Well, you might have a suit for all that unnecessary treatment. But the undue stress is a long shot. Your best bet, contact a medical malpractice attorney in your state who can show you what you may or may not be able to recover.
