The only paper I ever saw on this court situation said that I had to appear to tell why I wasn't in contempt of court for not showing up over a credit card... It said I should appear on the 17th. (this is the first time I have seen any information about this court situation) I came down with Pnemonia and was in and out of the hospital and in bed for 12 days. (I missed this hearing) I called the court house and explained that I had been sick and was wanting to schedule another hearing. I also called the prosecuting attorney and he has not returned my calls. I was told by the court that I have a warrant for failure to appear and I will go to jail with a bail amount 3,000. (what I owe on credit card) I have been paying for my bankruptcy for the last 3 months but can't get it filed until I pay for it in full. I have young children and lost my job after 7 years of employment. I live in Indiana. WHat can I do? Will I have to stay in jail until I pay for this credit card from 3 years ago? When I pay for the rest of my Bankruptcy and it is filed, will I be able to dismiss this debt.. Please help

Something doesn't sound right. Are you sure you missed the orginal court date or did you miss a courtordered debtor's exam? Either way, you need to see a lawyer. I'd hustle on that bk. Once you file bk, the bk court will give an automatic stay and collection activity will stop.

They tried to tell me I missed a previous court date. I'm the only one at this household besides my 2 young children. The only court document I have received from them is stateing that I missed a court date and I needed to be there on the 17th which was friday. I realize I missed it and called today.. this is the first time I've been out of bed in almost 2 weeks because of pnemonia. If I missed any other court appearance over this in the past than I NEVER received notification of the court date or I would have been there... Thanks for your reply.. Every bit of advice is appreciated.
