I missed my edd appeal date so did the employer I received a notice saying me and the employer where no shows decision dismissing appeal for no show. It says the appellant was served notice of time and place of hearing before the ALJ but did not appear therefore the case is dismissed what does this mean? I'm thinking I lost but can I appeal again i couldn't show up because I had a family emergency.

Your notice should tell you how to request a reinstatement of your appeal. A medical emergency may, in fact, allow you to have it heard. Our company had the exact thing happen. We missed the appeal hearing (we were the appellant) because our representative had a family emergency. They allowed the appeal to be reinstated.

How long has it been? What state are you in? Were you the appealing party? Apparently so, as you said you "lost." Which means your benefits weren't approved and you were appealing to get them approved in this hearing you missed, right? And very important, did you make any effort to contact the agency and tell them that you weren't going to be able to make it to the hearing? And hopefully, this happened, like yesterday. If it has been a few days, weeks, etc. that's going to make it less likely to happen. Requests for another hearing must be done in a timely manner.
