What is the name of your state (only U.S. law)? California
In 2003, my husband's grandparents added my husband and his father to the deed of their house (in joint tenancy). Grandpa died in 2005, so his name was taken off the title. In 2008, grandma's portion of the house was put into a trust and the title was changed so that the owners are my husband, his father, and grandma's trust, as joint tenants.
Grandma passed away this year and no one can find a copy of the trust. The lawyer that drew up the papers has also died, and we can't find any records. We are wondering what happens if the trust papers can't be found? Does the property have to go through probate? Is there a way to avoid probate? Is the family forced to sell the house?
