I have a case in work where a group of us said some things in the facebook messenger application chat (the separate application). I have a hearing where i may possibly get fired for a social media policy breach. I keep asking why the case is for "inappropriate facebook comments" when i have never posted on facebook itself. Are messenger applications such as messenger and whats app not private?

Many thanks for any help as i am struggling to find much information on this.

Kind regards,

Richard

What sorts of things did you say on this application that your employer is taking offense at?

I'm asking for a reason - it matters to your options.

Some not great things, i made fun that my boss had a beard like a terrorist and may have used some bad language and also made fun of another one that drinks a lot, but there were six of us colleagues in the group using it to vent and one of them decided to submit the conversation to management (no one knows who) , i always assumed it was private chat and could not be used, am i totally wrong? I never posted in work hours.

Many thanks,

Richard

Many thanks

"The other guys" took the time to respond to you because they thought you were in the US. Had they known you were in the UK, they wouldn't have wasted their time.

Okay, just to be clear, employment law in the US is nothing at all like the law in the UK. There are huge differences. We have no experts on UK law here, and any information we could give you on US law would be worthless to you since it does not apply on your side of the pond. We're not just being obstructionist.
