modify child support

Can you modify child support during bankruptcy proceedings?

Also, if there is no case open with CSE, can the non custodial parent ask that a case be opened so they can review current support orders?

Has anyone gone through Child Support Enforcement to modify the amounts? Do you still have to obtain a lawyer?

If you mean "Can child support be modified, through the proper court, while one party is going through bankruptcy proceedings?", the answer is yes. Bankruptcy and child support are separate matters, dealt with in separate courts. The bankruptcy really wouldn't have any affect on child support, as support will still be based on income.

I can't find anything on the CSE website that says the NCP can't initiate a case. You can find the info you need here:

Actually, if it was a chapter 13 bankruptcy, child support would definitely be a factor, a significant one. Therefore I am not certain that its absolute that CS can be modified during a bankruptcy. However, it may be that that bankruptcy would have to be continued until the child support review was finalized, rather than the other way around.
