mom keeps kids during my weekends

Hi,

my ex-wife and I share joint custody of our two children. she has them during the week and I have them every weekend and the specified holidays that we agreed to. see here is the problem in all the 4 years we have been divorced I have only one time asked her to keep the children on a weekend and that was for a funeral. but since then she has been keeping them whenever she wants, and she says its in the papers that she can keep them with notice. but the papers read that she can have them if we agree. I always pick them up at school on fridays (she woeks there) and she will take them somewhere before I get there and when I call her she says she will drop them on sat. is there anything I can do about this situation. please I need help because any time I go to court for anything it somehow is alway in her favor. :confused:

My response:

If you don't want to go to court again because "it somehow is alway in her favor" when you do go to court, then all I can suggest for you is that you do what any good New Jersean would do - - shoot the bitch. Then, find a construction site - - preferably where they're building underground parking, and then dump her lifeless body in the wet cement.

That's what a New Jersean would do!

A New Yorker, on the other hand, would use a tree chipper, and then dump the sinew and entrails into the East River.

But, what the hell do I know. I'm only an attorney in California.

is there anyone who knows if what she is doing is in violation on the divorce settlement or can she just get away with it? :confused:

If he has a CO that he has the kids from end of school through weekend, can he take a copy of CO to the principals office and demand that they not release kids to ex wife after school on Fridays in violation of CO? Would it at least create enough embarassment for her and pressure from school (as an employee there) to stop these games?

If not, THEN he can shoot the B****?

If you do nothing,, she sure can get away with it!

How about you write word for word what the CO says about weekend visitation?

i don't have the papers with me right now i am at work but it says i pickup the children after school at the school and the mother will pick them at 7:00pm on sunday. it also says that the father or the mother can have the children at any other times that are agreed upon.

You've already said you're not going to go back to court. So, what is it that you want - - a pep talk?

Oh, then I must have gotten you wrong then when you said, "any time I go to court for anything it somehow is alway in her favor."

I'll tell you what - - when you get some backbone, then come back and waste our time. This thread should have been, at most, two responses long. We don't have the time to "figure you out" or coddle you.

if you would try to help instead of being nasty this would have been shorter and may I point out you have given me no good advice to speak of so maybe that is why this was drawn out. I didn't think this was a place where I would be insulted. I was just trying to give some backround about court obviously I have a backbone because I have gone. I was just hoping to get clarification about whether they would just blow me off or if I had a case :mad:

Oh, so you want some coddling.

Okay. When you get tired of what's happening, and you're pissed off enough because you haven't seen your kids, then you'll get the "backbone" to file your "Order to Show Cause Re: Contempt of Court for Visitation Interference".

But, until then, and unless you ask a cohesive, cogent legal question, then no one is going to take you seriously - - especially when you say "show stopper" things like, "any time I go to court for anything it somehow is alway in her favor."

until you go against my lieing ex wife in court then you can talk. and as I recall you are the one that said this is too long a thread for this question. well then stop writing nonsense and let some intelligent people write.

He told you what you need to do, file an Order to Show Cause. Remeber, usually both parties come out of court going WTF just happened in there? I got Scr_wed!. Court never a good thing; however if you are really being denied your visitation, and your ex is unresonable, then yes court is your only answer left.

I will give you a personal experience. My husband took his ex back to court. When his attorney asked why he was doing this, WE told her: principel. Sometimes you need to do something, just because. You may lose the battle, but not the war. Very important to develope a legal record of contemptous behavior. Conserve your energy though, make sure it is worth the battle.
