mom needs advice for daughter in nyc

new york city...daughter is in nyc in college..got hired as bartender, then fired, because investor of bar, urged her, in order to keep her job, to admit what manager of bar was doing. She complied, to keep her job..only to be fired by manager the next day, for not being someone he could trust! Truth was, he was drunk while working. He admitted to her, that he was not proud of his actions, however, he didn't have room for someone that would "rat him out"! I, now find out, that, she was not being paid an hourly wage, never filled out an application, never filled out a W-2 form, etc..she was basically, just working for tips. I know this is illegal in PA, just want to know NY laws. Please advise!

She was working under the table and since she is an adult, she chose this job. She got fired, and I really do not understand why you are involving yourself so much.


Do you want her to sue to get her "No Paying" job back? She was aware that she was being paid under the table. Why else did she not question the "W-2"? They can fire her for any reason.

Your daughter being fired by the manager because she told the owner the manager was drunk at work was not illegal. Unfair of course but it wasn't against the law. As to the bar's pay practices, yes, they are illegal but your daughter will also be in the soup with the State and federal IRS if she didn't declare all that cash income and pay taxes as required.

My advice is that your daughter use this as a learning experience. Their pay practices alone should have been a big red flag that she wasn't working for a reputable/ethical employer and there's never a happy ending when that's the case.
