I bought a house a little over a month ago. Before I would close, I had the seller hold out $2000.00 of escrow to complete the repairs in the kitchen. (Tile work and redo the hardwood floors) Little did I know that the space for the fridge was not indusry standard. So, in addition to having the kitchen repairs they needed to take care of, they also had to slide the cabnets over so the fridge would fit.
On the agreement that held out the $2000.00 it says if the work is not completed by 12/01/2000 the money goes to the buyer if the work is not completed or I am not satisfied.
Having them slide the cabnets over took one day(Nov 28), but the original work has not been completed. In fact, the last day of November and the first of December they finally had someone work on the tile for the countertops(until 8 pm).
The work was terrible, the tiles were not level and the wood around the frame was cracked. I have gone one month without a fridge and they did not offer to help us in any way.
I called the title company and asked for all of the money to forwarded to me, but the seller would not agree. He suggested he would give me 1000.00 and for me to fix the countertops myself. He would have the floors fixed. I told him my wife and I have been eating out every day for the last 30+ days and I has cost me alot of money. He told me that I knew it could take 30 days. I then told him that the fridge had nothing to do with the 30 day agreement.
I am sorry for dragging the story out so long. Legally, what can I do? And if I get the money, he still has to fix the kithen...correct?
