My daughter confided in me over the weekend that ehr dad told her that if she keeps insisting that she wants to live with me he will hurt me. This is not the first time that he has done this. She told her GAL about his threats 2 years ago, and she told her that she did not believe her.

I have filed contempt charges against dad for refusing to allow the first rght of refusal. I have had phone calls from my daughter crying and begging me to pick her up. She cries at every return, and she begs me to not make her go back to ehr dad's house. Her dad will not take her to therapy anymore. He changes jobs frequently and has no insurance on her. He was ordered to provide insurance. She is on my husband's insurance, and her dad knows it, but he stilkl denies medical treatment.

I left him 8 years ago when I finally had enough of his beatings. I was not going to allow our daughter to grow up in a home with domestice violence. I knew that it was not right, and I wanted her to grow up in a good home. Of course her dad now denies being abusive, and he claims that I was the abuser. I lost custody last winter after a horrible eval that went on for several years, and was done by an evaluator who I now know almost always states that dad should have custody.

What can I do to get my daughter some help, and eventually at home with me. Dad is remarried, and with his history I'm sure he is abusing his wife. I'm not the first woman he beat. I'm sure I won't be the last. My daughter won't talk about it. When I asked her if there was a reason that she did not want to go back to her dad's she only cried harder. She told me about the threats, and but she wouldn't say anything else. I don't have an attorney anymore. The judge wouldn't hear evidence that dad was in contempt for refusing me the first right of refusal and puttign our daughter in daycare for several days of summer vacation.

What can I do to help my daughter? My ex seems to have everybody in the courts under his control. I was beaten and terrorized by thisd man for years. What can I do to make it right for our daughter. I don't want her to live her life like that.

What Is Child Abuse and Neglect?

Physical abuse is nonaccidental physical injury (ranging from minor bruises to severe fractures or death) as a result of punching, beating, kicking, biting, shaking, throwing, stabbing, choking, hitting (with a hand, stick, strap, or other object), burning, or otherwise harming a child, that is inflicted by a parent, caregiver, or other person who has responsibility for the child.2 Such injury is considered abuse regardless of whether the caregiver intended to hurt the child. Physical discipline, such as spanking or paddling, is not considered abuse as long as it is reasonable and causes no bodily injury to the child.

Neglect is the failure of a parent, guardian, or other caregiver to provide for a child’s basic needs. Neglect may be:

* Physical (e.g., failure to provide necessary food or shelter, or lack of appropriate supervision)
* Medical (e.g., failure to provide necessary medical or mental health treatment)3
* Educational (e.g., failure to educate a child or attend to special education needs)
* Emotional (e.g., inattention to a child’s emotional needs, failure to provide psychological care, or permitting the child to use alcohol or other drugs)

These situations do not always mean a child is neglected. Sometimes cultural values, the standards of care in the community, and poverty may be contributing factors, indicating the family is in need of information or assistance. When a family fails to use information and resources, and the child’s health or safety is at risk, then child welfare intervention may be required. In addition, many States provide an exception to the definition of neglect for parents who choose not to seek medical care for their children due to religious beliefs that may prohibit medical intervention.4

I spoke to CPS about the situation in the past. They said that they will not get involved because I reported it. They feel that it is a custody dispute.

CPS in NW Indiana is horrible. It is better, lots better, in the southern part of the state, but I am dealing with a poor system that won't do anything. I told my daughter that she needs to confide in someone, her teacher, nurse, school counselor, etc.

What Is Child Abuse and Neglect?

Mental abuse is hard to prove. It is hard to prove that he is harming her by not allowing her to see a therapist.

This is a difficult situation. I used my change of venue. We have a "special judge" who is too busy to hear important cases or facts.

My daughter thinks that if she confides in someone they will go back to her dad and tell hom what she said. Then he will hurt me. I've tried to tell her that her dad won't hurt me, that I won't let him hurt me, but she is scared. She really believes that he will hurt me. What can I do for her legally?

CPS will not investigate if I report it. There are no visible bruises. She calims that he is not hitting her right now. Is there anything I can do that does not involve CPS? If not how do I get CPS to investigate? My daughter is in a horrible situation.
