What is the name of your state (only U.S. law)? DE

My wife's best friend's new love interest appears to be a suspicious character with a serious drinkng problem. Last Sat at 3pm he was arrested and jailed for driving with expired registration (his sister-in-law's car) and having an open can of beer. The car was impounded. He passed the sobriety test so no DWI. My wife's best friend bailed him out at 7pm. According to him, he has a prior DWI, presumably in DE.

Questions:

1. Does it sound plausible that you can be jailed for an expired registration plus driving with an open container?

2. Would the previous DWI be a factor in the decision to arrest and/or the determination of bail?

3. Is it possible that this guy will eventually do time for what happened on Sat given he already has a DWI?

It is worse than we thought. He has been muttering about getting 2-5 years so this must have been his 4th DUI. When my wife's best friend found out, her main concern was that he would have to go cold turkey with cigarettes and beer. Can you believe it? Her boyfriend may have to do 2-5 and she is worried that he won't be able to get smokes! My wife finally told her to stop calling everyday because she is tired of hearing what a great guy he is and how he has been a victim of the system. I have seen plenty of enablers in my day but nothing like this.

And you care because?

And WE should spend our limited time on this because?
