Mortgage Co. Told Neighbor Personal Info!

We are behind on our mortgage. My neighbor came over to stay with the kids while I ran to the store. The Mortgage company called while I was gone. They asked to speak to my husband. My neighbor told them we were not home. The MC then informed my neighbor that our house was in pre-forclosure and if when intended on keeping the property that, we had to make payment in the amount of $________.
We are working on the payment, but this is not info I wanted public! Is there no privacy laws to protect us? They have also left msgs on my answering machine when my mother-in-law was over, and could hear!! Please Help!!

My response:

Yes, it is a "slimy" tactic for them to do this. It's highly embarassing, and meant to be just that.

Unfortunately, there's nothing you can do about it. You see, a creditor collecting a debt for itself (i.e., not through an attorney or a collection agency) is not liable for such tactics under the Federal Fair Debt Collections Practices Act - - which would otherwise protect you under such circumstances.
