What is the name of your state? Arizona
Me and my wife are selling our home for $471K and we bought a new house for $450K We are financing $225K. My credit is bad so the mortgage company wants to use my wifes excellant credit for the loan. (I have paid all her debts for the past 4 years on time, thus her Excellant credit) They want me to sign a disclaimer deed. Now you see my problem? I have a lot of equity in the home we are selling, do you think I want to give it all away? Sheesh! Is there something else I can suggest to the mortgage co. where I can retain my portion of ownership as we are a community state. I came across a form called: AZ Affidavit - acceptance of community proprty with right of survivorship. Can I ask them to accept this instead?
