I have gotten a divorce and filed chapter 7. I have gotten a certified letter stating my ex-husband is in default on a mortgage that was in both our names. I believe my ex-husband vacated the property in May of this year. I am no legal expert but it looks like they are trying to get me to pay 70,000 dollars for default. Since I left my ex I have never wanted the house. Many people on here ask how they STOP a foreclosure. Well as credit damaging as it is I would just assume to let them take the house. They are also claiming the value of the house is depreciating due to my ex-husband neglecting it. Is the worst case scenario that they will foreclose and just charge me attorney fees and whatever value has been lost in the property? I listed this house/mortgage on my bankruptcy but a stay has been terminated. My ex during the divorce had refused to sign anything stating I was giving up all claims to my half of the property. I just want to let the house go. I have not lived there for 4 years now. Is there anyway they would just go after the ex since I have not lived there since way before he defaulted and I filed divorce and bankruptcy way before the loan default?
