What is the name of your state? WI

18 years ago my husband loaned his father money. A mortgage was filed with the court stating that his father owed this back to him and my husband held a 2nd mortgage on the house. Promissory note was signed as well as mortgage. No payments were ever made on the loan. Parents are now deceased. Is the mortgage still a legal binding document even though no payments were ever made on it?
