My parents avoided a foreclosure by obtaining a remodification under the HARP program when it was first introduced several years ago. In short, since the modification, he was always current with payments for several years. Last year, he was killed in an auto accident via a medical incident. He did not have a will. My mother, on SSI, has been meeting the payments but has not notified the mortgage company in fear they will look at her source of income and foreclose. She has also avoided probate for this reason. However, we have managed to keep the payment current.

When my father first signed the remodification, he was the only name on the agreement but my mother was on the deed. He also demanded mortgage insurance in case of an emergency (ironically). A year before his death, he received "updated" paperwork from his mortgage company asking for BOTH their signatures. She cannot find the mortgage insurance deduction on her statements but is afraid to ask for the reason I mentioned above.

Oddly enough, my father received a post card from the company handling the class action law suit forcing their customers to take an overpriced insurance.

It's been an extremely rough year, so forgive me for not being concise, but I am unable to help my mom financially with a lawyer as I have taken on a couple other bills and am raising my daughter, so I am asking: are there any major ramifications she should worry about at this point in regards to the mortgage company? She is also afraid of other bill collectors at this point so that she can keep the mortgage current. Any advice would be sincerely appreciated.
