Mother didn't change childs name after being ordered to do so

What is the name of your state? WV

The mother of my husbands child originally gave his child a different mans name. So at the support hearing she said she would change childs first and last name. The order states "(mother) will be changing childs name from (current name) to (new name) and the birth certificate will be amended with childs new name."

Well we claimed his child on our taxes this year and when the cpa ran the childs new name and social they didn't match. So I gave her the childs old name and they matched. Is the mother supposed to have his name changed with the social security administration too? My husband doesn't have a copy of the new birth certificate. But he can obtain one if he wants. Is she breaking any laws here?

I also have another question.
The mother was on welfare and went through the state for support. She said they made her take the support. So I've heard that if women are on welfare they only get a portion of the money the state recieves from the ncp. Is this true? I would think once child support is established the state would cut off tanf and forward all the money to the cp. Am I wrong?

Well he got in touch with the caseworker. she said they would keep the money in there until the child is 18. and if he ever becomes behind they would apply it to the arrears. So...if anyone is interested.

No one cared how it is disbursed. I could care less how the mom gets the money. I could care less how it's applied. No one said I was deciding anything. I was asking if it could be used for those purposes. People on this board are jerks. What's with the power trip? I'm a geologist and i am sure i make as much or more money than some of you. And yet..i dont think i'm any better.

Go find another board where the members are not jerks.

She may not have known that she also needed to change it with the Social Security Administration. That's not an uncommon problem. If she didn't change it with vital statistics either, then she is in contempt of court.

Generally the cp has a choice. If TANIF is more than the ordered child support, then the cp can keep the TANIF. If the TANIF is less than the ordered child support, the cp can opt to give up TANIF and keep the full amount of the child support. However, some states do tie child support to other things than just TANIF, so if she is in one of those states, she may not be given any options other than to go off of all assistance altogether.
