Gonna post this question here because I'm not sure if it pertains more to family law or wills and probate.
We reside in NJ.
Here is my situation: My mother has just been diagnosed with stomach cancer...she has custody of my 13 year old sister. We would like to know if she should have an attorney draw up a will granting me guardianship of my sister. Father's situation: lives in IL, lost custody and visitation rights due to conviction of child molestation and consequent "interference of custody" by taking his 3 kids out of the state of NJ and back to IL when mother was at work..
We are worried that he will have his family fight for custody, they reside in FL, and would like to avoid that before it even happens. They have not seen or contacted my sister since she was 3 years of age. My mother is not likely to die due to her illness, but having this diagnosed made her realize her circumstances.

Dear Deefran:

This same subject has come up a few times on the boards. Try running a search using the above phrase, " . . . search over 155,000 previously posted questions and answers . . . "
for those posts, using the term "Troxel". and read all of those posts. I do understand your situation, and recall a recent, and very similar, post that I responded to about 1 or 2 weeks ago.
