I applied H1b visa for 2018 fiscal year. i got picked by End of April . I got a RFE on September.
since i dont have Bachelor degree. i have done 3 years Diplomo Engineering and I have 10 years Experience . Additionally i have already been in USA for 1 years 8 months on H3 Special Training at our US Head Office

My Attorney replied to my RFE with credit evaluation report from a evaluating Agency / university.

my application denied on oct 15th . the denial reason stated as : “ you did not submit evidence that the University of Arizona has a program granting college level credits based on training or work experience.”

My attorney and employer are applying for MTR. with additional document from the evaluating agency.

i really worried what would be the result of MTR and how long it would take

is there anyone went thru similar situation. please respond

Your attorney would be able to give a better idea than we can, but frankly it looks bleak. The H-3 training is not going to be considered valid for this purpose. It actually makes things worse as it appears you are gaming the system. The H-3 is designed not as a path for you to eventually work in the US, but to obtain traning to work outside the US. I suspect you already counted that time in your ten year experience anyhow.

It's clear you don't meet the explicit requirements (it's a degree or TWELVE years experience). CIS is looking for some indication that you have enough college to justify a degree level issuance or something that indicates (other than the same ten years experience you are already claiming) that you have the "specialized" level that the H1B is based on.
