Moved out before lease expired

What is the name of your state? CA

I moved from Texas to CA 6 months into my 1 year lease. I understand I am responsible for the balance of lease. However, it is also my understanding that if the landlord leases the apt. before my lease, I am only required to pay for any time the apartment was not lease (plus some misc charges).

The apartment complex I lived in was very elite and there was a waiting list for my floorplan so I know it didn't take them the full 6 months to lease my apt. However, the entire balance of the lease has showed up on my credit report.

How can I find out exactly when my apartment was leased to the new tenants. I am currently in CA and the apartment is in Tx.

You are correct, I had the same thing happen to me just recently. The landlord is entitled to any lost money, not the entire amount, then they are collecting double. I would contact the apt manager and explain that you are interested in finding out how long the apt was vacant before they were able to find someone to move in. If it seems reasonable then explain your understanding of the law and ask if you need to speak to anyone in particular to get it cleared up.

If they say something that is ridiculous then you may want to have a friend call up and confirm that they have a waiting list for that type of apt. If that is the case, call them back and confront them and ask them if you can work this out or if it will be necessary to get lawyers involved.

I hate to be the bearer of bad news, but breaking a lease and moving out of state is no different then giving the landlord a blank check. He filled in the amount for 6 months and you said it was OK, until now.

I really can't see how you can solve this problem unless the same tenant who moved in the apartment after you is still living there and they have a copy of their lease. Then you compare the date you moved out with the start date of their lease and sue the landlord in TX for the difference.
