We informed our landlord a month ago that we have bought a house and will be moving the first week of November. We rent month to month, no lease, so there's no conflict there. I asked him, knowing full well the answer in advance, if we could break the month's rent into half due to the fact we would be out before then. He, as expected, said no because he wouldn't be able to rent the house out for those 2 weeks and would be out the $500. Fine, no problem, I understood but figured I'd give it a shot just for the heck of it.

I have since learned that he will be moving into this house after we move out. (His children go to school with mine, they've been telling people they're moving into our house as soon as we go.) Since we will be paying the full rent for the entire month of Nov. does this mean we retain the right to keep things here until the end of Nov.? Or to put off the final cleaning until we're a bit more settled into our new house, without worrying that he'll be moving his family in and claiming the house wasn't cleaned to his liking and keep our deposit? If we're paying the full month's rent shouldn't be be able to use that full month whether it is to stay longer before moving or store items that can be left behind for a week (or three), etc. ? Just want to cover us in case of there being a potential problem. Thanks.

Inform your landlord that, as he has not been able to get a renter to cover the remainder of the lease and you are paying for the place anyway, you have decided to stay until lease end and get some work done at the new house before moving in, taking your time to move.

See if THEN he offers to let out of the remainder of the lease.

That's pretty much what we were thinking of doing. It would be so much easier knowing I had the extra time to get moved in and settled before I had to make the 100+ mile trip back here to make sure everything was cleared out and cleaned up. I'm sure not going to put off the move any longer than possible.

Do you know then if he would like to take possession before the end of the month, would he have to forfeit the second half of November's rent? Because if not, I'll be sure to let him know we won't be totally out until the end of the month. Who knows, maybe they'll want to move in sooner rather than later and he'll be a little more flexible.

Just tell him since he wont prorate the rent your not giving up possession until the last day of the month in a certified letter and your things are not to be disturbed on your paid time that you have made a photo inventory of the things in the house as well as will take pics of the final move out condition of the house .

His daughter was just here, and told me how excited they are about the move. And how they "just can't wait". Maybe I will be saving that $500 after all. Or if they're in that much of a hurry, the entire amount. But, if he's not willing to work with us, they'll just have to wait.
