My fiance and I have been together for a year and a half. He has lived w/ my children and I for 9 months. He is divorced and his son lives in Florida w/ his mother and half brother and sister.We are in Illinois. I have 2 children. Their father and I were never married and have no formal custody agreement. I do have a 2yr. Order of Protection against him.(He does get visitation in it) The Order granted me Temp. Custody. We are considering moving to Florida. I know my ex will not give consent and I will have to petition the court. What will the court look at? What are the chances of having this move approved? I am willing to give him liberal visitation.(summers,Christmas and Spring breaks, and being open to him visiting Florida) Also helping financially w/ travel expenses.

Plan what breaks you want and let him know that this is what you want. Make him understand that you both must agree in order for this relocation to work. Therefore, he has to give you his input.
How much notice do you have to give him before you can move?
