moving out of state

What is the name of your state (only U.S. law)? AR

I have a quick question. At the time of my last custody modification, I was planning a move out of state to be close to relatives. Received permission to move out of state and worked out a visitation agreement. Our order lists which state I was moving to. I ended up not moving because the family that we were moving to be close to were transfered to another state for their jobs(after almost 14 years of being in one location - go figure).

The question is - I was under the impression that once permission to move out of state was given - it didn't matter which state you moved to - just that there was the permission to move out of state.

Now that the family has moved and gotten settled, I have visited the area and done some research and I thinking of moving to the new location.

what would I have to do for this to happen? Do I need to file new papers with the court and request permission again or just file something stating this is where I am moving?

Also, what's the timeline of these events? When was the order made? When were you supposed to move? When are you planning on moving?

He left state to chase jobs all over the country and is no longer here so I researched the area and decided for us to move there.

about a month after we finished with our modification (not just over moving, that was just a part of it), my dad received the news that he was being transfered to another state. It has been about a year. He is settled with a home and I recently visited. I loved the area and it has alot to offer for a child, especially in education - at least compared to where we are now. I have not even decided to move there yet, just thinking about it so wondering what would have to be done since I already received permission to leave the state and have a long distance visitation arrangement.
 
The order was entered about a year ago. I found out about a month later that the move would not take place (see previous post - this thread). Was supposed to move to IN.
current move - if it even happens (as I said - I am just doing prelimiary (sp*) research) would be Dec 2009 to CA.

Since you were granted to move once, I think its likely you will be granted the move again, especially considering dad is not in the state anymore.

Absolutely file a new plan with the court to CYA.

Question - does the child's dad object to this move? Did he object before?

You have permission to move to Indiana. If you'd like to do that, I suppose no one can stop you. However, your previous motion said NOTHING about CA, so you better have the court revisit that issue.

You may want to research more than just the educational activities, CA is notoriously expensive and the cost of living between AR and CA or even IN and CA is enough to make you think you may want to stay where you are. Unless you plan on living off your parents, make for darn sure you can SUPPORT your child in this economy we have out here, it's going to cost you.... and airfare won't be cheap either.
 
Don't know if he would object to this move - haven't discussed since I haven't made any decision on whether to persue it or not.
He did not object to the move before - we actually came up with the visitation arrangment for after the move between ourselves.
He is all over the country in different states ever month or so - it doesn't affect his time with DD at all. We basically follow the out of state arrangement anyway since he is not in the state.

Yes, you could do that, however, I will reiterate what CC said. CA is an extremely expensive place to live....particularly housing. So please do some more research before you decide to move there. You need to be sure that you can truly afford it.
 
I am still doing some research. Like I said this is just the beginning stages. No sense in doing all that other research if it wouldn't work on this end. Custody issues are always the best starting point.
when/if this move actually happens I will have just completed school and will be a licenced LPN. from what I have found, the cost of living is very high in CA, but you also make alot more as well. The cost of living is something like 20% higher, but the rate of pay is higher by 23% (for LPN's I don't know about everything else) so it pretty well evens out.
I want to go on to become an RN. So I am also checking into the nursing schools out there and the help avaliable (scholarships etc) for single parents. The amount of resourses for single parents that want to attend school seem to also be more abundant there.
There has not been any decision made - I am just poking around at if this could happen and if it could the area/schools/ housing/ jobs/ etc.

I don't know what it would actually be called in AR as opposed to here, but if it were me, I would file a motion to amend previous judgment and simply amend it to state that you're allowed to relocate to another state - leaving the actual state open.

I can't find the AR statutes on the subject, but I'm betting if YOU can, they'll tell you whether or not you need court permission to relocate. And I'm betting you don't.

But please DO consider what everyone has said about COL in CA as opposed to AR. Of course, it depends on where in CA you're planning to live, and where you'll be working as an RN... pay varies widely.
