Moving out of state

I currently live in California and I was just offered a great job opportunity in Texas. I would love to move with my family. I have a son of age 13 that I have full physical custody of. Both my son's mother and I have joint legal custody. His mother has failed to pay child support for the last 10 years until recently when the DA's office was able to collect through her employer. She owes me over $40,000 in back pay.

My question is: If I can provide a better life for my son leaving out of state, do I have to file anything with the DA's office? What are my rights? Thank you!

The fact that your ex wife owes a lot in arrearages (support) will not be grounds for you to move the child out of State.

The choices are;

Go to mediation, get a signed agreement between the two of you for permission to move out of the jurisdiction of California.

OR

You can petition the courts for permission if your X doesn't want you to leave the State with the child.

Both will take into consideration the wishes of the child, due to his age. Be prepared to explain the quality of life you can provide if you were granted permission to move. Be reasonable as to different visitations schedule with Mom, and don't be suprised if you are requested to pay for travel expenses - since you are the one moving.

If you and the X have an (verbal) agreement for you to move put it in writing, otherwise it may came back on you if you don't.

You must tell her within 45 days of your intent to move so that she may file a motion in court.
