I am writing for opinions if I have a medical mal-practice suit

About 9 years I started having tingling sensations, numbness etc in my feet and legs

My family doctor gave me various painkillers that help to some extent

over the course of the last 9 years, the symtoms became progressivly worse. There were periods that were good, and others that were worse

whenever the symtoms became worse....and I did some research, my thoughts were that it could be MS. My doctor told me no, that x-raysmri's of my lower back suggested lumbar stenosis or quada aquina
I asked him directly, could it be MS and he said no

during the last 3 years, the symtoms got worse and worse, vision problems, spasticity, balance problems, mild depression to the point where in the last
few months I could barely walk.

Finally, it got to the point that I demanded to be send to a specialist a neurosurgeon. I actually had made two appts with two different doctors

the first doctor looked at my lower back mri and ruled out stenosis and quada aquina quickly. A mri of my upper spine and neck showed no back issues either

this doctor checked my reflexes and and as soon as he saw how strong they were suggested a MS like disease. My family doctor always said my ultra strong reflexes was good, this doctor said it was a telltale sign of MS especially when added to my 4-5 other symtoms

I had also been going to physical therapy and the therapists there always thought I should look at MS....even they suspected

I was referred to a MS specialist where a brain mri showed 12 lesions---MS
My family doctor had nevered orderd a brain scan or upper back and neck scan

MS has no cure but if I was treated with avonex 4,5,6,7, or 8 years ago the progression of my mS would be considerably less

just wondering if I have a mal-practice case in regards to mis-diagnosis and the failure of my doctor to at least test for MS

My only advice is to consult with a medmal attorney in your area. Depending on the jury's and/or court's trend on holding the patient responsible for seeking alternate medical care, you may or may not find an attorney willing to so much as investigate your claim.

Best wishes,
EC

I wonder what your primary care doc was thinking! for real I'd like to get his version of the story. Because anybody with a medical degree should recognize these symptoms even in his sleep. The most confusing thing about it all is that he didn’t think of referring you to a neurologist when your symptoms didn’t get better. This story has ruined my day. If all you said is true I think you have a good case here. I will help you find a good attorney if you have problems finding one

My advice to you is not to inquire why or wither but just to enjoy your ice cream while its still on your plate

do you feel my case is weakened because I did not go to a specialist on my own

I simply trusted my doctor. I have gone to him for over 20 years, he is our family doctor. He insisted to me up to two months ago that it was not MS and was a stenosis issue. It was I who in the last couple months demanded that he send me to a nerosurgeon so I could get the stenosis corrected.

When the specialists, (actually, I went to two different specialist) saw my x-rays, they quickly dismissed stenosis or any other back condition. They said the mri showed nothing very abnormal. When the first specialist checked my reflexes he seemed to know right away that it was MS or related disease

again, is my case weakened by not going to a specialist alone. I trusted my doctor who said all along that I had stenosis and it was not yet serious enough back 7,6,5,4,3,2,, years ago to operate on

Go see a medmal attorney immediately. Have them review the case.

The only thing I question is why you never sought alternative opinions, and you WILL be asked that too, be prepared.

Good Luck!

Your entire chart will have to be reviewed,
The standard of care for your family doc is different than that for a specialist.
Who read the Xrays?
The MRI of the brain is more diagnostic than the other tests and hindsight is 20/20.
MS can and often does wax and wain for years, some never have more than mild symptoms, others have severe and unrelenting symptoms immediately.
Do you have insurance? If you do how do you request referal to a specialist? Appeal?
If you are self pay, that may limit how much you request expensive visits to specialists and expensive diagnostic testing.
Again, a review of your chart will yield more answers.
Consult a med-mal attorney who will have your case reviewed and advise you.
